Brian Johnson Hires Neighbor who doesn’t have a License, to Operate the Town’s Heavy Front Loader.

An exclusive Investigation by the Holland Blog brought another highly irresponsible blunder perpetrated by elected Highway Surveyor Brian Johnson to light.

After an investigation initiated by The Holland Blog, the Police Department (HPD) confirmed today in its official report that Brian Johnson hired his neighbor Alexander A. Haney III to operate a town owned 21,585 lb Front Loader knowing that his neighbor had neither the qualifications nor a license to operate the heavy machine.

You would expect a responsible town official trusted with expensive equipment worth hundreds of thousands of dollars to hire operators who are qualified and legally licensed to operate such heavy equipment.
Unfortunately this is not the case.
It is a scary proposition that someone would drive a piece of machinery weighing 21,585 lb with speeds up to 25 mph through our narrow snow covered streets and around the Holland Elementary School without training and proper license.

Brian Johnson’s neighbor Alexander A. Haney III, was operating the heavy Front Loader, a John Deer 544H, yesterday, Tuesday January 18, 2011, in front of the Holland Elementary School. I spotted him after a visit to the Assessors Office and walked over to take pictures with my I-Phone.

As I took the pictures shown here to catch Haney in the act, Haney exited the heavy Front Loader and approached me swearing like a drunken sailor. Alexander Haney exiting the Front Loader with his cowboy boots
He claimed that I (scum bag) would not have the (f---ing) right to take any (f---ing) pictures, and that he was (f---ing) gonne (f---ing) kick my (f---ing) ass if I (f---ing scumbag) would not (f---ing) stop taking (f---ing) pictures, (Haney has a somewhat limited vocabulary). Alexander Haney just before he launched his assault.
Haney did not kick my (f---ing) ass but he hit me to catapult my I-Phone out of my hands.

Corporal Jeffrey K. Forcier from the HPD was just on his way to have lunch when he noticed the yelling. He informed Haney that I had all the right to take his picture and that he should stop yelling. It was my first contact I had with Corporal Jeffrey Forcier and his professional conduct was impressive!
Subsequently, I filed a voluntary statement against Haney for assault. Officer Forcier called the State Police who assisted Forcier in the ensuing investigation at the Highway Department.
The investigation confirmed that Alexander Haney had no license to operate the heavy front loader and that Brian Johnson was fully aware of the fact that his neighbor had no license!

42 year old Haney will face charges for assault, threat to commit a crime, and to operate without a license.

The implications of Brian Johnson’s irresponsible conduct are huge. Brian Johnson is not only toying with the safety of every member of our community, he is also subjecting the community to potentially grave liability in case of an accident. Last but not least, unqualified operation of this expensive piece of equipment may result in costly damage.

Despite the fact that two individuals reported to me also having seen Alexander Haney operating the Front Loader on public roads throughout our town over the last few days, Brian Johnson tried to minimize the situation.
According to the official report of the HPD, Brian Johnson stated, “he [Haney] normally operates a regular pick up truck to plow. However, on this day one of the trucks was away for repairs (...)”

Brian Johnson, are you kidding me?? He “normally operates a regular pick up truck,” and then you just let him drive a 21,585 lb heavy front loader because the pick up truck is being repaired? Knowing that Haney does not have the needed license??

Alexander Haney entered my radar screen back on September 30, 2009. I was working on the piece Office or residence? to inform readers of the Holland Blog that Brain Johnson was president of J&G Construction Inc., and two other town employees working under Brian Johnson were vice president and director respectively.

I drove to the “headquarters” of Brian Johnson’s construction company, his residence on 61 Stafford Road, to take a picture.
Alexander Haney conspired with Brian Johnson, both lying to Trooper John A. Puccia from the State Police and Acting Chief Bryan Haughey of the HPD, claiming I had trespassed onto Brian’s property.
Acting Chief Haughey’s sharp mind recognized that the pictures on my digital camera told a different story, and Brian Johnson and Alexander Haney were exposed as liars.

Haney seems to have had other problems recently. The HPD allegedly removed several firearms from Haney’s resident on 65 Stafford Road here in Holland. I will try to find out why the fire arms were removed from his residence and inform the readers.

More Bad News About The Unlicensed Operator Of The Town's $200,000 Front Loader Hired By Brian Johnson.

This piece does not need much explanation. It is an official Police Report from the Holland Police I obtained from the Palmer District Court about the individual our elected Highway Surveyor and son of Earl Johnson, Brian Johnson, hired to operate the town's heavy Front Loader, knowing that this individual had no license to operate the heavy Front Loader.
The name of this individual is Alexander Haney, a neighbor of Brian Johnson.

  1. At approximately 10:07 p.m., on Thursday, June 24, 2010 I, Corporal Jeff Forcier was dispatched to the area of 208 Mashapaug Road and Union Road for a report of a vehicle off the road in a ditch, with unknown personal injury. I activated the emergency blue lights and audible siren and proceeded to the above location arriving approximately 4 - 5 minutes later.
  2. Upon arriving at the corner of Mashapaug Road and Union Road, I observed an unoccupied blue Ford Explorer SUV bearing, Massachusetts Registration # 98JV51 stuck on a stump. This vehicle appeared to have crossed completely into the opposite lane of travel and came to rest upon a stump which was approximately five to ten feet off the roadway in the wood line. This vehicle appeared to cause slight damage to the grass area and stump located on Union Road, which is a public way owned by the town of Holland. A person later identified as Scott Balderelli was attempting to attach tow chains from his vehicle to the unoccupied SUV. I questioned Balderelli and he told me he did not know who the vehicle belong to, but his wife (Diane) had just asked him to tow the vehicle off the stump. I asked Balderelli if the SUV belonged to him; he said no and again stated his wife had asked him to help get the MV off the stump, but he did not know anything about the registered owner and the person was gone when he arrived to tow it. It should be noted during my conversation with Balderelli he appeared to be exhibiting nervous indicators, his speech was stuttered and he made little eye contact with me. While speaking with Balderelli, I asked (C8) dispatch to run a listing on the SUV and found it was registered to a Holland resident named Alexander Haney. I had prior knowledge that Haney and Balderelli were friends, because earlier this evening at approximately 7:06 p.m., I was dispatched to Haney's residence for a medical call involving his mother. Mrs. Dianne Balderelli arrived at Haney's residence driving Haney's SUV without him being present. It should also be noted during this time Haney's live in girlfriend told me it was better he stayed where he was, because he had been drinking all day and he would only complicate things. Additionally, I had conversation with Haney earlier this day at approximately 6:17 p.m., while I was investigating a separate incident involving his son. At that time, I observed his eyes were red and glassy, his speech was slurred and he was exhibiting very aggressive behavior by yelling and swearing using the word fuck multiple times. I advised Haney if he continued to yell and swear he may create a breach of the peace and be subject to arrest. See incident # 10-67-OF and 10-68-OF. It was during this time, I also learned Haney had just recently lost his job, and was experiencing domestic issues with his live in girlfriend.

  3. While speaking with Balderelli an unidentified resident of Union Road approached me and told me he just heard someone running through the woods behind his house, which was in close proximity to this accident location. I developed concern for Haney's safety/ welfare and formed the opinion he may be in need of further medical attention, if he had been operating the SUV and fled on foot when he heard the sirens approaching. Therefore, I radioed C8 and requested a State Police K9 unit for suspect tracking and I began a perimeter search. I also requested One Stop Auto be dispatched for the tow and I took digital photos of the property damage - see attached.
  4. MSP Troopers Lablanc and Quirk arrived to assist in addition to the covering MSP K9 unit. The K9 immediately picked up a track and the K9 Trooper told me the dog tracked the scent across the street from our location up a hill to a house. I knew the house to be # 6 Pleasant Street which is the residence of Balderelli - the person who was attempting to tow the SUV (Mr. Scott and Mrs. Diane Balderelli). Trooper Lablanc and I went to this residence and we had conversation with Scott Balderelli. I informed Balderelli the dog had traced Haney's sent right up to his house. I further explained the reason for our concern and I advised him of my community caretaking obligation with regards to Haney possibly being sick or injured. It was at this time,

    Balderelli told me he understood, and Haney did make it to his house while we were searching for him. Balderelli (Scott ) told me Haney was not injured and no longer present in his house, because he told him he had to leave and could not stay. I asked if we could enter his residence to be certain and Scott said we could because he wanted to prove to us that he was telling the truth. Scott escorted us throughout the house and we had negative contact with Haney. During this time, I had conversation with Ms. Diane Balderelli and she told me Haney called her and told her he was driving his car and got it stuck on a stump and he wanted help from them towing it back onto the road. Diane further said Haney had been drinking alcohol all day and she was concerned for him, because he has a very bad case of diabetes and alcohol has a lot of sugar. She also told me he did go to their house while we were searching for him, but they told him he could not stay there. She told me he left and walked through the woods and called her from behind PJ's bar asking her to go pick him up. Diane stated she told him she would not do that and he should walk out into the road and turn himself in, because the police were still looking for him. Diane further informed me she had taken Haney's girlfriend to the Harrington Hospital to see his mother and was with her all night, just incase Haney tried to lie and say he was not driving the vehicle, his girlfriend was. This information was consistent with incident # 10-68-OF.

  5. At approximately 12:06 a.m., One Stop arrived on scene for the tow and they removed the vehicle. As a result of the above incident, I recommended a twelve hour hold be placed on the vehicle.
  6. On Saturday June 26, 2010, at approximately 11:16 a.m., I issued Haney a Massachusetts Uniform Citation/ Criminal Application # M6674890 for 90-24/C Leaving the Scene of a Property Damage accident. It should be noted that I made an error on this citation and listed the date of citation as 6-29-2010 instead of 06-26-2010. Upon receiving the citation Haney said " I didn't think I caused any property damage." I informed him the grass had been disturbed, the tree stump had been marked and his vehicle was damaged which was also considered property as it relates to this charge.

Birds of a Feather...

Smith & Wesson hand gun. Not the gun found at Haney’s home, just for illustration purposes. Here is another piece that does not need much explanation. It is the most recent official Police Report from the State Police I obtained from the Palmer District Court about Haney.
The accused individual is again the same our elected Highway Surveyor Brian Johnson hired to operate the town's heavy Front Loader.
Brian Johnson knew that this individual had no license to operate the heavy Front Loader.
Haney is so close to Brian, that his daughter (who choose to get involved) called Brian “uncle.” In her comment left on January 22, 2011 at 13:32 hours, she wrote:

“nd i love the ‘thugs with guns’ comment hahaha.”

Little did I know that her daddy was not only a thug, but also had allegedly a gun without a license. He allegedly also had brass knuckles (not a garden tool by the way).
Maybe the worst, Brian’s buddy and close friend Alexander Haney was allegedly repeatedly stealing money from his OWN DISABLED MOTHER...

I Trooper Luis DeJesus of the Massachusetts State Police respectfully submit the following:

On 01-08-2011 I at approximately 11;37hrs I responded to a call at 65 Stafford Road in the town of Holland. The resident NIEMEYER, Ruth MA OLN: SXXXXXXXX/04-04-1952 (disable person) wanted to file charges against her son for stealing her identity, getting a Walmart Credit Card (#XXXX XXXX XXXX XXXX) and charging $778.00 to it. She stated that she never gave her consent to get a credit card in her name. She stated that she was tired of her son HANEY, Alexander A MA OLN: SXXXXXXXX/07-02-1969 and his girlfriend a Kim Cyr MA OLN: SXXXXXXXX/12O1-1970 of Sturbridge constantly stealing from her. She said that she was made aware of the existence of the credit by Walmart creditors, who call the house looking to settle the debt. She also had received a letter from NCO Financial Systems INC. She then looked for the credit card in her sons room because she suspected this was his doing. She' found the Walmart Credit Card inside her sons wallet on top of the bureau in his room. She handed me the NCO Financial Systems Inc letter and the Walmart Credit Card as evidence. As I was standing in the living room of 65 Stafford Road in the town of Holland speaking with Mrs. NIEMEYER I could see into her sons room and observe a black handgun on top of a table. The handgun was not properly secured, was in plain view, and was laying on top of a pair of brass knuckles. NIEMEYER informed me that was her sons room and that was his gun. I informed her that it was illegal to just leave a loaded gun laying about like that without at the very least a trigger lock. The pistol had a loaded magazine with-8 rounds inside the magazine. I asked NIEMEYER for a consent search to make sure there were no other unsecured weapons laying about. I located a loaded 12 ga shotgun laying on top of a table in the basement. The weapon had two 12 ga slugs in its magazine and there were an additional two 12 ga. slugs right next to the gun. Both weapons were secured and taken as evidence. Holland Police officer Fourcier arrived on scene to assist, I advised him of the situation and he suspended HANEY'S FID on MIRCS for improperly secured firearms, as well as a possession of of handgun without a license.

I will be requesting a subpoena for record to Walmart Fraud Investigators concerning the charges to the credit card, times, dates ect.. When Holland PD spoke to HANEY he stated that it was Kim CYR who filed the paperwork and got the credit card from Walmart. However both parties have being actively using the credit card since July 27, 2009 until January 2, 2011. Kim CYR was only able to obtain a Walmart credit card on Ruth A. Niemeyer's name because HANEY provided her with his mothers information. The credit card was found by his mother inside his room, in his wallet, he was in constructive possession of the card. Surveillance video has being requested from Walmart Corporation showing both HANEY and CYR using the card. Walmart has already provided detail statements regarding the use of the card, and have requested to also be named as victims of Credit Card Fraud.

Brain Johnson’s Unlicensed Friend & Neighbor Alexander Haney faced a District Judge Today.

Alexander Hanye’s assault towards me back on January 18, 2011, in front of the Holland Elementary School and Town Hall was the third incident during which Alexander Haney harassed and/or threatened me. Under G.L. Chapter 258E, a judge can issue a so called “HARASSMENT PREVENTION ORDER” in severe situation where the harassment reaches the criminal threshold set by the legislature in G.L. Chapter 258E.

Alexander Haney had some creative defenses for Presiding Justice Honorable Patricia T. Poehler of the Palmer District Court, among them:

  • He was living in Holland all his live and gets along with everybody.
  • My allegations would be ridiculous.
  • He did not hit me causing my I-phone (camera) to be catapulted into a snow bank, instead, I was slipping on the ice and threw my I-phone into a snow bank myself.
  • My request for a Harassment Prevention Order would be part of a vendetta against town officials.
  • I would be bulling town officials with my blog.
  • He would not even know where I live.
  • And the best of all:

  • There was kind of a state of emergency due to road conditions; I had no business to be out on the road!
  • In regards to my concern about the allegations against Haney levied in the police report by Trooper Luis DeJesus from the Massachusetts State Police he claimed:

  • He would have a right to have a handgun inside his house, he would just not have the right to bring the handgun outside.
  • The gun was found and confiscated during an illegal “search and seizure” by the State Police.
  • The allegations and the fact that the police found brass knuckles and a handgun in his possession would not have any bearing on the issue whether a Harassment Prevention Order should issue.
Justice Honorable Patricia T. Poehler found otherwise and issued the order, and did so for an entire year.

Justice Poehler scheduled a hearing for February 27, 2012, during which she will make a decision whether to extent the order to protect me from further harassment of Brian Johnson’s close friend and neighbor Alexander Haney.

Palmer District Court found probable cause to issue a criminal complaint against Brian Johnson’s neighbor, friend, and former employee of the Highway Department, Alexander Haney.

The charges stem from the incident whereby Haney attacked me while I was taking pictures of him operating the 21,585 lb front loader. Brian Johnson hired his friend and neighbor despite the fact that Haney had neither the proper training nor the required license issued by the Department of public safety to operate the heavy front-loader.

Haney lawyered up for the show cause hearing last Thursday, July 8, 2011 at Palmer District Court. During the hearing, Haney’s lawyer claimed that I’m the instigator and aggressor, but First Assistant Clerk Magistrate Jane A. Filipek didn’t seem to buy it.

Haney will be back in court for a second show cause hearing on additional “Criminal Harassment” charges pursuant G.L. c. 265, s. 43A.

Haney will be arraigned thereafter and will have to stand trial some when in the future.

Back on February 28, 2011, Honorable Justice Patricia T. Poehler issued a so called “Criminal Harassment Prevention Order” to protect me from further criminal harassment perpetrated by Brian Johnson's friend and neighbor, Alexander Haney. Alexander Haney Holland MA.
