Brian Johnson failed to get the necessary permits from the DEP to perform work within the Wetland Buffer zone.
The work, as performed, was in violation of M.G.L. and provisions of the C.M.R., hence the $12,000.00 fine!
The irony here is that our town officials are guilty of the illegal acts they wrongfully accused James LaMountain of doing. James LaMountain enjoys an exemption as a farmer and was exonerated three times, the last time on April 22, 2010, by Honorable Justice Moriarty II. The Holland Blog reported about the decision in the piece, James P. LaMountain exonerated again, this time by Justice Moriarty II.
At last night’s selectboard meeting, the chairman of the Board, James Wettlaufer, stated, “it was a misunderstanding on the part of the Highway Department..”
The Highway Department habitually digs near the different lakes and ponds in town without the proper permits; this time I reported the illegal activity by Brian Johnson’s Highway Department to the DEP for a change, hence the $12,000.00 fine.

The DEP offered to stay part of the fine if the town of Holland is willing to organize a seminar for its officials and officials of the three surrounding towns Brimfield, Wales, and Brookfield. Holland would have to organize the seminar meant to inform and educate officials of the requirements in connection with the Wetland Protection Act.

The system lasted just about half a year.
Global warming is causing more often sever weather than we experienced in the past.
Here is where the water comes from; down the hill behind PJ’s:
Was the System adequate or not? Was the size of the drain shown to the right in the picture below too small or to big? The water rushed out of the paved spill way on the right causing a little canyon leading around the pipe opening at the water’s edge.

I was curious whether the hillside property of the LaMountain's held up during the heavy rain of this past Sunday to Monday night. I went up the road to the top and searched for any signs of erosion... There was none, absolutely none! All the catch basins James LaMountain built were intact and were able to handle the water. Just amazing!
